1. Who is providing this service

Fresh Start is operated by Tzvika Besor, an individual. No company has been formed for this business yet, and how it will eventually be structured (a locally incorporated company, a company formed abroad, or another arrangement) has not been decided. Until that's settled and a company exists, "we," "us," and "Fresh Start" in this document mean Tzvika Besor operating under the Fresh Start name. If and when a company is formed to take over this business, these Terms will be updated to name it and you will be told.

2. Who this is for

Fresh Start is for adults navigating job loss. You must be 18 or older to use it. We do not currently verify age at signup — by using Fresh Start, you are stating that you are 18 or older. If it becomes clear a user is under 18, Fresh Start stops processing new information, tells you plainly that it's built for adults, keeps showing the crisis resources in Section 5, and points you to the same export-or-delete controls described in the Privacy Policy — the choice of which is yours, the same as it would be for any user.

3. What Fresh Start is — and is not

Fresh Start is a coaching and companionship product for people navigating job loss.

It is not therapy, not a medical device, and not a crisis service. It is designed so that the moment you need more than it can give, it hands you to real human help — for free, without friction, and without ever having monetized the moment that got you there.

Concretely, that means:

  • We never describe what Fresh Start does using the words "therapy," "therapist," "treatment," "clinical," or "diagnosis." Nothing in the product should read that way, and if it ever does, that is a bug, not a feature.
  • We never claim to be licensed to provide medical, psychological, legal, or financial advice, and nothing in the product should be treated as such advice.
  • We never promise a specific outcome — a job offer, a placement, a timeline, or a particular emotional result. Coaching and companionship help; they cannot guarantee results, and we will not tell you otherwise.
  • The product will tell you, plainly and up front, that it is an AI and not a person. It will keep telling you this — not just once at signup. (This disclosure, and the crisis-referral behavior in Section 5, are required by California's AI companion chatbot law, SB 243 — we're following it everywhere, not just for California users.)

If you are looking for therapy, medical care, or a crisis service, Fresh Start is not that, and this document and the Privacy Policy describe the real, human-staffed resources we point you to when it matters.

4. Your account, your consent

Creating an account itself doesn't require this consent — you can sign up and answer a few light, practical questions first. Before Fresh Start asks you anything about how you're feeling, it asks for one up-front consent, described in full in the Privacy Policy, covering how that information is used, including that the founder, Tzvika Besor, can read what you tell it. There is no partial version of this: you either consent to the whole thing, or you don't go further into the product. Withdrawing consent means deleting your account — there is no separate "opt out of part of this" mode, because the product is not built to run that way. Deleting your account is always available, one tap, and is never delayed or interrupted by anything else in the product — including an active safety conversation.

5. Crisis support, and the limits of what we do

That system reviews every message you send — not a person watching live, but software checking automatically, every time — for signs that you may be in crisis: thoughts of self-harm, an intent or plan, hopelessness with risk markers, harm toward another person, or an acute crisis in the moment. It is deliberately tuned to flag more often than it has to, not less — you may sometimes see it respond when you weren't actually in crisis. It can also fail — it may respond late, respond to the wrong thing, or miss a real crisis entirely. It is automated and it is not a substitute for reaching out yourself. If you are in immediate danger, please contact emergency services or the resources below directly rather than relying on Fresh Start to notice.

When it does flag something, Fresh Start gently checks in and, whether or not you say you're okay, shows you real, human-staffed resources: in the US, the 988 Suicide & Crisis Lifeline and the Crisis Text Line; outside the US, the worldwide directory at findahelpline.com; and everywhere, 911/112/999 for immediate danger. This same resource list is always available, signed in or not, at the `/help` page on the Fresh Start site — never limited by whether you've paid, and never something we charge for or use to sell you anything.

Fresh Start does not resolve a crisis itself. It connects you to people who can, and then steps back. It does not operate a hotline. There's no guaranteed time within which a human reviews a flagged message — it could be quick or it could take a while — and Fresh Start does not collect your phone number or physical address, so even if the founder reads what you wrote, reaching you outside the product, or getting help to you, may not be possible on that alone.

We do not promise absolute confidentiality. If something you write leads a reasonable person to believe there is an imminent threat of serious physical harm to you or to an identifiable other person, the founder may — after reviewing it, and only then, never automatically — contact emergency services or law enforcement to try to prevent that harm.

6. Payment

During the current alpha, Fresh Start is free. No payment method is collected and no charge will occur.

The terms below describe how payment will work once a paid tier launches, so you know what to expect. They do not apply yet.

  • Fresh Start is sold as a program package, not an open-ended subscription — like an annual plan billed monthly. Once you enter a package, all of its billing cycles are part of that commitment; ending early does not undo cycles already billed, outside the refund window below.
  • Refund: within 14 days of your first payment, you can request a full refund, no questions asked, once. This is stated here and in Settings → Billing during the eligible window — it is not advertised as a marketing offer.
  • After a package's committed period, it continues month-to-month, at a lower price than the package itself, until you cancel. Cancelling stops future billing; it does not retroactively refund the completed package outside the 14-day window above.
  • Landing a job during your program does not change your billing — the commitment already entered doesn't reverse because your situation changed for the better.
  • If a payment fails, we'll retry it automatically over a few weeks. Your access does not drop the moment a payment fails, and none of this ever touches or delays the crisis support described in Section 5.
  • Fresh Start costs what it costs; we don't currently run discounted or pay-later programs. If a payment plan changes for you specifically, we'll tell you directly.

7. Your data

How your information is collected, used, protected, and deleted is described in the Privacy Policy and, for consumer health data specifically, the Washington Consumer Health Data Policy. Both are part of these Terms.

8. Acceptable use

Don't use Fresh Start to harm, harass, or impersonate someone else; to attempt to break, overload, or reverse-engineer the service; or to use it in a way that could put another person's safety at risk. We can suspend or close an account for behavior like this.

9. No warranty

Fresh Start is provided "as is." We do not guarantee it will be uninterrupted, error-free, or that its coaching will produce any particular result. Software fails sometimes; when it does here, we'll fix what we can and tell you plainly what happened.

10. Limitation of liability

Fresh Start's safety-detection system, described in Section 5, is automated and probabilistic: it can fail to detect a real crisis, respond too late, or respond to the wrong thing. It is not a substitute for calling emergency services yourself if you are in danger, and you should not rely on it to notice something is wrong.

To the fullest extent the law allows, Fresh Start (and Tzvika Besor personally, as its current operator) is not liable for indirect, incidental, or consequential damages arising from your use of the product, including damages arising from the safety-detection system failing to detect, or responding late to, a crisis. Nothing in this section limits liability for gross negligence, willful misconduct, or anything the law does not allow us to limit.

This section has not yet had a dedicated counsel review specific to Israeli law — see the status note at the top of this document.

11. Ending your use of Fresh Start

You can delete your account at any time — see the Privacy Policy for exactly what that does and doesn't remove. We can suspend or close an account for a violation of Section 8. See Section 2 for what happens if it becomes clear a user is under 18.

12. Changes to these Terms

If we change these Terms in a way that matters to how the product treats your data or your safety, we'll tell you before the change takes effect, not just post a new date at the top.

13. Governing law and disputes

These Terms are governed by the laws of the State of Israel. Any dispute arising from these Terms or your use of Fresh Start is subject to the jurisdiction of the courts of Israel.
